General information

By submitting the application by the Candidate for the position indicated in the advertisement, the Candidate consent to the processing of personal data by Varsofia (Registration No. 7011036703) based at 16 William Heerlein Lindley Street, 02-013 Warsaw, Poland for the purposes necessary for the recruitment process (in accordance with the Act of 10 May 2018 on the protection of personal data (Acts of 2018, item 1000) and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR)).

(Consent is given for additional personal data that are not indicated in the relevant legislation or that are not necessary for the conclusion of the contract if the Candidate submits such additional personal data in the application).

By ticking the appropriate box, the Candidate may also consent to the processing of the personal data contained in the application for future recruitment conducted by Varsofia.

The Candidate may withdraw consent to the processing of personal data contained in the recruitment application for recruitment purposes at any time by sending such information using the form here. The withdrawal of consent to process personal data does not affect the lawfulness of the processing that Varsofia has carried out on the basis of the consent given before its withdrawal.

Legal reference

Personal data will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“GDPR”) for the following purposes and on the following legal bases:

  • in order to carry out the recruitment process in the scope of the personal data indicated in Article 221 § 1 of the Polish Labour Code or possibly in other relevant legal acts in the case of a desire to be employed on the basis of an employment contract – on the basis of Article 6(1)(c) of the GDPR (legal obligation) or – in the case of a desire to be employed on the basis of a civil law contract – on the basis of Article 6(1)(b) of the GDPR (taking action prior to concluding a contract);
  • in order to carry out the recruitment process in respect of the non-compulsory (additional) personal data indicated by the Candidate in the recruitment application (including, inter alia, image, interests, etc.) – on the basis of Article 6(1)(a) GDPR (consent of the data subject);
  • for the purposes of future recruitment processes (where prior consent has been given for future recruitment) – on the basis of Article 6(1)(a) GDPR (consent of the data subject);
  • for the purpose of establishing, investigating, or defending against claims on the basis of Article 6(1)(f) GDPR (processing is necessary for the purposes of legitimate interests pursued by the controller or by a third party consisting in the defence of rights).

Provision of the personal data indicated in item 1 above is necessary in order to take part in the recruitment process, whereby in the case of a desire to be employed based on an employment contract, providing the data covered by Article 221 § 1 of the Labour Code (Poland) is a statutory requirement, and in the case of a desire to be employed based on a civil law contract – a condition for concluding the contract. Failure to provide the indicated personal data will make it impossible to participate in the recruitment process.

Other personal data

Other personal data included in the recruitment application is provided voluntarily and failure to provide it does not prevent the Candidate from taking part in the recruitment process. During the recruitment process, Varsofia also collects personal data contained in various documents, such as notes from the recruitment interview, references, documents authorising legal work, and information obtained in the course of recruitment. Failure to provide the personal data indicated may not be obligatory in some cases but may limit Varsofia’s ability to consider an application.

Recipients of personal data

We may share the Candidate’s personal data with public authorities where we are obliged to do so under applicable law, recruitment management systems, IT service providers and information systems providers, as well as with our business partners and our clients in connection with the provision and supervision of the services we provide.

International transfer

As Varsofia, we need to share processes to ensure our efficiency and effectiveness. Accordingly, we transfer some personal data to countries, territories or organisations outside the European Economic Area. For transfers to territories not recognised as offering an adequate level of protection by the European Commission, we apply the standard data protection clauses adopted by the European Commission or other mechanisms for the transfer of personal data provided for by the GDPR.

Storage of data

We will retain the Candidate’s personal data for as long as necessary for the purposes set out above, or as long as required by law. The Candidate data will be deleted at the end of the recruitment process but no later than 24 months from the date of receipt application for employment unless the Candidate consent to its use in other recruitments. If the Candidate consent to use data in other recruitments, they will be deleted no later than 60 months from the date of receipt of the employment application. In the case of processing based on the Candidate’s previously given consent – the Candidate data will be processed until the Candidate withdraws consent. In the case of processing on the basis of Varsofia’s legitimate interest – until the purpose of the processing is achieved or until an effective objection is made.

Candidates’ personal data rights

The Candidate has the following rights regarding personal data:

Access

The Candidate can request free access to personal data.

Amendment

The Candidate can request Varsofia to correct inaccurate or incomplete personal data.

Erasure

The candidate may request Varsofia to erase personal data for any of the following reasons:

a) when the personal data are no longer necessary in relation to the purposes for which they were collected or processed in any way;

b) when The Candidate withdraws the consent on which the processing is based if there is no other legal basis for the processing;

c) when the personal data have been processed unlawfully;

d) when the personal data must be erased in order to comply with the legal provisions of the European Union or a Member State to which Varsofia is subject;

Restriction

The Candidate may request Varsofia to restrict the scope of processing personal data for any of the following reasons:

a) the Candidate challenges the accuracy of his/her personal data, for a period of time that allows Varsofia to verify the accuracy of the data;

b) the processing is unlawful and the data subject objects to the erasure of the data and instead requests the restriction of its use;

c) Varsofia no longer needs the Candidate’s personal data for processing purposes, but the Candidate needs them for the purposes of determining, applying or defending against claims;

Portability

The Candidate may request Varsofia to transfer the personal data provided to it to another organisation and/or to receive personal data in a structured form and in an easily accessible format.

Withdrawal

The Candidate may at any time withdraw consent to the processing of personal data in respect of which the Candidate have previously given such consent. However, the withdrawal of consent does not affect processing activities that took place prior to the withdrawal of consent.

Objection

The Candidate may object to Varsofia’s processing data for direct marketing purposes, or otherwise in accordance with local legislation, by informing the HR Administration department of the objection.

Complaint

The Candidate have the right to lodge a complaint with the supervisory authority, i.e. the President of the Data Protection Authority.
